Gift Deed Stamp Duty in Ujjain (MP): Rates and Process
Key takeaways
- Official MP chart (as on 9 Sep 2025): family gift = 2.5% stamp duty + 3% municipal (or 1% janpad) + upkar + 0.8% registration.
- That totals about 6.55% inside Ujjain city and 4.55% in rural janpad areas.
- Gifts to non-family members cost about 11.5% urban / 9.5% rural - the same as a sale.
- The '1% capped at Rs 1,000' figure on some websites does not match the official chart for immovable property.
- Confirm the relationship category and final amount in SAMPADA 2.0 or with the Sub-Registrar, then apply for mutation.
Gift deed stamp duty in Ujjain, per the official MP chart (as on 9 September 2025), is 2.5% for a gift of property to a family member, plus 3% municipal duty inside city limits, an upkar of 10% of that duty and a 0.8% registration fee: about 6.55% in all. A gift to anyone else costs about 11.5%.
These figures come from the MP Stamp Duty and Registration Fee Chart (mpigr.gov.in) published by the Department of Registration and Stamps, Madhya Pradesh. This guide reads that chart row by row for gift deeds (daan patra), splits the cost between Ujjain Municipal Corporation limits and rural janpad areas, works through a full example, and explains why several popular websites quote a much lower figure. Rates are revised from time to time, so treat every number here as correct for the chart dated 9 September 2025 and confirm the final figure in SAMPADA 2.0 before you pay.
Gift deed stamp duty in Ujjain: the short answer
A gift deed is the document by which an owner transfers a house, flat or plot to someone else without any payment. In Madhya Pradesh it is charged under the Indian Stamp Act, 1899 as applied to the state, and the official chart lists two rows for gifts of immovable property: one for a gift to a member of the family and one for all other cases. Registration is compulsory in both cases, so an unregistered gift deed of land or a house in Ujjain is not an option.
- Family gift, inside Ujjain city (municipal area): 2.5% + 3% + 0.25% + 0.8% = about 6.55% of the value.
- Family gift, rural (janpad area): 2.5% + 1% + 0.25% + 0.8% = about 4.55%.
- Gift to anyone else, urban: 5% + 3% + 0.5% + 3% = about 11.5%.
- Gift to anyone else, rural: 5% + 1% + 0.5% + 3% = about 9.5%.
The totals are simple arithmetic on the official components; the chart itself lists each component separately. If you are weighing a gift against a normal sale, our guide to property in Ujjain and the companion page on stamp duty and registry charges in Ujjain cover the sale-deed side, so this page sticks to gifts.
Official rates, component by component
Four separate charges make up the cost of registering a gift deed in Madhya Pradesh. Each one is shown as its own column in the official chart, which is why a single headline percentage can mislead.
| Component | Family - urban | Family - rural | Non-family - urban | Non-family - rural |
|---|---|---|---|---|
| Principal stamp duty | 2.5% | 2.5% | 5% | 5% |
| Municipal duty (municipal body area) | 3% | - | 3% | - |
| Janpad duty (rural janpad area) | - | 1% | - | 1% |
| Upkar (10% of principal stamp duty) | 0.25% | 0.25% | 0.5% | 0.5% |
| Registration fee | 0.8% | 0.8% | 3% | 3% |
| Total (derived) | 6.55% | 4.55% | 11.5% | 9.5% |

Gift to a member of the family
The family row carries the concessional principal duty of 2.5% and, importantly, a registration fee of 0.8% rather than the 3% charged on most transfers. The upkar is not charged on the property value directly: the chart fixes it at 10% of the principal stamp duty, so on a 2.5% principal duty it works out to 0.25% of the value.
Gift to anyone else
When the person receiving the property does not fall within the family definition, the chart applies 5% principal duty, the same municipal or janpad duty, an upkar of 10% of the principal duty (0.5% of value) and a 3% registration fee. In practice this makes a non-family gift cost the same as an ordinary sale of property in Ujjain city.
Urban (Ujjain Municipal Corporation) vs rural (janpad) land
The second component depends on where the property sits. Inside a municipal body such as the Ujjain Municipal Corporation, 3% municipal duty applies. On land in a rural janpad panchayat area of Ujjain district, 1% janpad duty applies instead. One deed attracts one of the two, never both. That single difference is why a family gift of a farmhouse plot outside the city costs two percentage points less than the same gift of a house inside city limits.
Worked example: gifting a house in Ujjain city
Take an illustrative house inside Ujjain Municipal Corporation limits whose value for stamp purposes is Rs 40,00,000. This is an example figure chosen to make the maths easy, not a rate or a price for any locality. The value used in a real deed is assessed in SAMPADA 2.0 on the basis of the collector guideline value for that location, or the value stated in the deed if that is higher.
| Component | Rate | Amount (family, urban) | Amount (non-family, urban) |
|---|---|---|---|
| Principal stamp duty | 2.5% / 5% | Rs 1,00,000 | Rs 2,00,000 |
| Municipal duty | 3% | Rs 1,20,000 | Rs 1,20,000 |
| Upkar (10% of principal duty) | 0.25% / 0.5% | Rs 10,000 | Rs 20,000 |
| Registration fee | 0.8% / 3% | Rs 32,000 | Rs 1,20,000 |
| Total | 6.55% / 11.5% | Rs 2,62,000 | Rs 4,60,000 |
On this example the family concession saves Rs 1,98,000. Note how the municipal duty is the same in both columns: the saving comes from the lower principal duty, the smaller upkar and, above all, the 0.8% registration fee. If the same Rs 40,00,000 property were in a janpad area, the 3% municipal line would be replaced by 1% janpad duty (Rs 40,000), bringing the family total to Rs 1,82,000, or 4.55%.
To find the guideline value for your own property, check the current Ujjain collector guideline rates for the colony or village, multiply by the area, and then apply the percentages above. SAMPADA 2.0 does the final calculation, and that figure is the one you actually pay.
Why some websites say "1% capped at Rs 1,000"
Search for gift deed stamp duty in MP and you will find several finance and property portals stating that a family gift costs 1% stamp duty with a maximum of Rs 1,000, and that registration is 3%. Others quote 2.5% without the municipal duty or upkar. One widely read guide carrying these figures was updated as recently as May 2026.
Those numbers do not match the official chart. The chart dated 9 September 2025 shows 2.5% principal duty on a family gift of immovable property, adds municipal or janpad duty and upkar, and sets the registration fee at 0.8%, not 3%. We could not find any later amendment that reintroduced a Rs 1,000 cap for immovable property. One possible source of confusion is that the chart has a separate row for gifts of movable property to family members, which carries 1% duty and a flat Rs 500 registration fee; that row does not apply to a house or plot.
Do not budget from a portal's headline figure. Download the chart from mpigr.gov.in, check the gift rows yourself, and let SAMPADA 2.0 generate the final amount. If anything differs from what you see here, the figure in the official system and at the Sub-Registrar office prevails.
Who counts as family? Confirm before you pay
The concessional 2.5% / 0.8% row applies only to a gift to a "member of the family" as defined for that entry of the MP schedule to the Indian Stamp Act. The relationship list is exactly where mistakes are expensive: if the person receiving the gift is not covered, the deed attracts the non-family rate of about 11.5%, and the difference may be demanded later as deficit duty.
We have not reproduced a list of qualifying relatives here because we have not verified the current text of the schedule entry. Before you draft the deed:
- Ask the Sub-Registrar office in Ujjain, or the service provider preparing your deed, which relationships the family row covers today.
- Check how SAMPADA 2.0 classifies the deed when you select the gift instrument and the relationship.
- Keep documents that prove the relationship (for example ID and family records) ready for the registration appointment.
- For anything unusual, such as a gift through a trust, a firm, or between in-laws, take advice from a property lawyer.
Step-by-step: registering a gift deed in Ujjain
Gift deeds go through the same online-first system as other property documents in Madhya Pradesh. The broad sequence is below; the detailed screens are covered in our Ujjain property registry process guide.
Valuation and duty calculation in SAMPADA 2.0
The deed is prepared in SAMPADA 2.0, the registration and stamps portal of the Department of Registration and Stamps. You enter the property details (ward or village, khasra or house number, area, construction) and choose the gift instrument with the correct relationship. The system works out the market value from the collector guideline and calculates principal duty, municipal or janpad duty, upkar and the registration fee.
e-stamp and appointment
Duty and fee are paid online, the e-stamp is generated against the deed, and you book a slot at the Sub-Registrar office that has jurisdiction over the property. Keep the payment receipt and the draft deed number handy.
Execution before the Sub-Registrar with witnesses
On the appointment day the donor (the person giving the gift) and the donee (the person receiving it) appear before the Sub-Registrar with their identity documents and the witnesses required by law. The deed is signed and attested as required under the Transfer of Property Act, 1882 and registered under the Registration Act, 1908. Once registered, you can download or collect the registered copy.
After registration: mutation (namantaran)
Registration transfers ownership, but municipal and revenue records still show the old owner until you apply for mutation. Inside the city that means the property-tax record with the Ujjain Municipal Corporation; for agricultural or rural land it means the revenue record (khasra). Our step-by-step guide to property mutation in Ujjain explains where and how to apply.
Gift deed vs will vs sale: which costs less?
Families often ask whether to gift a property now, leave it by will, or record a sale. The cost of a transfer deed is only one factor, but it is the one the official chart settles clearly.
| Route | Total % (urban) | Total % (rural) | Source |
|---|---|---|---|
| Gift deed to a family member | about 6.55% | about 4.55% | Official MP chart, as on 9 Sep 2025 (derived totals) |
| Gift deed to anyone else | about 11.5% | about 9.5% | Official MP chart, as on 9 Sep 2025 (derived totals) |
| Sale deed | about 11.5% | about 9.5% | Official MP chart, sale/conveyance row, as on 9 Sep 2025 (derived totals) |
| Will | Not a transfer during the owner's lifetime | - | Not charged like a conveyance; costs and process differ |
What the table means in practice:
- For a genuine gift within the family, the gift deed is clearly cheaper than a sale on paper, roughly 5 percentage points less inside city limits.
- For someone outside the family, a gift saves nothing over a sale, so the choice should rest on the real nature of the transaction, not on duty.
- A will does not transfer property while the owner is alive, so it is not a like-for-like alternative. Tax consequences of gifts are outside the stamp chart; ask a tax adviser before you sign.
If the plan is to sell the family home and buy something new rather than to gift it, the listings in houses for sale in Ujjain let you compare what is on the market.
Common mistakes that cost Ujjain families money
Most gift-deed problems come from five avoidable errors:
- Budgeting from a portal figure. A family that plans for 1% and is asked for 6.55% at the counter either delays registration or borrows at short notice.
- Choosing the wrong instrument or relationship in SAMPADA 2.0. The system calculates duty from what you select; a wrong selection means wrong duty and a possible deficit demand later.
- Understating the value. Duty is charged on the assessed market value, so writing a lower figure in the deed does not reduce the charge below the guideline value.
- Skipping mutation. Without namantaran, property tax bills, utility connections and a later sale can all get stuck in the old owner's name.
- Ignoring rural vs urban status. Some localities on the city's edge fall outside municipal limits; confirm whether municipal or janpad duty applies before you calculate.
Every figure on this page is taken from the official chart as on 9 September 2025. This is general information, not legal or tax advice. Rates and rules change, so confirm the applicable duty with the Sub-Registrar, Ujjain or a qualified lawyer before executing any deed.
Frequently asked questions
What is the stamp duty on a gift deed in MP for family members?
As per the official MP chart (as on 9 September 2025), a gift of immovable property to a family member attracts 2.5% principal stamp duty, plus 3% municipal duty in a municipal area or 1% janpad duty in a rural area, and an upkar of 10% of the principal duty. With the 0.8% registration fee the total is about 6.55% in Ujjain city and 4.55% in janpad areas. Confirm the final figure in SAMPADA 2.0.
Is registration of a gift deed compulsory in Ujjain?
Yes. The official chart marks registration as compulsory for gifts of immovable property, both to family members and to others. The deed is executed before the Sub-Registrar who has jurisdiction over the property.
How is stamp duty on a gift deed calculated - on market value or guideline value?
Duty is worked out in SAMPADA 2.0 on the market value of the property, which is assessed using the collector guideline value for that location, or the value stated in the deed if that is higher. Writing a lower value in the deed does not reduce the duty below the guideline-based figure.
What is the registration fee for a gift deed in Madhya Pradesh?
The chart sets the registration fee at 0.8% for a gift to a member of the family and 3% for a gift to anyone else. Figures of 3% quoted for family gifts on some websites do not match the chart as on 9 September 2025.
Do I need mutation after a gift deed in Ujjain?
Yes. Registration transfers ownership, but the municipal property-tax record or the revenue record still shows the previous owner until mutation (namantaran) is done. Apply with the registered deed at the Ujjain Municipal Corporation for city property or through the revenue office for rural land.
